Civil liability coverage for the freight forwarder against harm to the client.
A product exclusively for logistics operators and freight forwarders in Peru.
Starting in 2019, the requirements to operate as a freight forwarder were changed. One of them is to hold a third-party liability policy.
The Comprehensive Logistics Policy provides coverage for the freight forwarder’s civil liability for the risk of a failure in the service it provides that could harm the client.
Damage to or loss of cargo during transport, transshipment and loading and unloading:
The insured is covered for liability for causing damage or financial loss because of harm to its clients’ cargo, arising from error, omission or breach of its contractual activities that as a result affected the cargo.
The P.I.L. Comprehensive Logistics Policy is designed for logistics operators and freight forwarders in Peru, under Law 28583 (DS 025-2019-MTC). It covers third-party liability for a failure in the service that could harm their clients.
Coverage of loss of or damage to the cargo is extended for a stay in a customs warehouse or bonded facility for up to 90 days, both for total losses and for partial damage caused directly by error, omission or breach of its contractual activities that as a result affected the cargo.
The insured is covered for liability for causing damage or financial loss affecting the container used to transport the cargo, whether the containers belong to its clients or it is contractually responsible for them, arising from error, omission or breach of its contractual activities.
The insured is covered for the financial losses incurred by its clients, arising from an involuntary error or omission in the performance of its professional activity as a logistics operator.
The insured is covered for the financial losses its clients claim and prove, arising from an involuntary error or omission in the performance of its professional activity. The insured is covered for liability for its client’s financial losses, not for its own operating losses.
The insured is covered for liability for causing financial loss because of the harm its clients may suffer, arising from an error or omission in delivery. This shows up as a dispatch error, meaning the goods were sent to the wrong place, and it produces extra costs.
The insured is covered for liability for the financial loss caused by an incorrect declaration or an omission in its B/L, AWB, inland bill of lading or another contract of carriage or handling document.
Liability is covered for handling formalities with customs if the insured acts under a contract of carriage that includes an instruction to handle the cargo at customs or customs declarations, or if it receives that kind of instruction for a fee.
